Successful Transactions

I. General Provisions

1. These General Terms and Conditions (hereinafter referred to as "Terms and Conditions") are issued in accordance with Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code").

(hereinafter referred to as the "Seller")

2. These terms and conditions govern the mutual rights and obligations of the seller and a natural person concluding a purchase contract outside their business activities as a consumer, or within their business activities (hereinafter referred to as the "Buyer") through a web interface located on the website.

3. The provisions of the terms and conditions are an integral part of the purchase contract. Deviating arrangements in the purchase contract take precedence over the provisions of these terms and conditions.

4. These terms and conditions and the purchase contract are concluded in the Czech language.

II. Information on Goods and Prices

1. Information about the goods, including the prices of individual goods and their main characteristics, are provided for individual goods in the online store catalog. Goods prices are quoted inclusive of value-added tax, all related charges, and the costs of returning the goods if these goods, by their nature, cannot be returned by standard post.

2. All presentation of goods placed in the online store catalog is of an informative nature, and the seller is not obliged to conclude a purchase contract regarding these goods.

3. Information on costs associated with packaging and delivery of goods is published in the online store.

4. Any discounts on the purchase price of the goods cannot be combined, unless the seller and buyer agree otherwise.

III. Order and Conclusion of Purchase Contract

1. Costs incurred by the buyer when using distance communication means in connection with concluding the purchase contract are borne by the buyer themselves.

2. The buyer places an order for goods via their customer account or by filling out the order form without registration.

3. When placing an order, the buyer selects the goods, quantity, payment method, and delivery.

4. Before sending the order, the buyer is allowed to check and modify the data entered.

5. Immediately after receiving the order, the seller sends the buyer a confirmation to their email address.

6. If any requirement stated in the order cannot be fulfilled, the seller will send the buyer an amended offer.

7. All orders accepted by the seller are binding.

8. In the event of a clear technical error on the part of the seller in indicating the price, the seller is not obliged to deliver the goods at this clearly erroneous price.

IV. Customer Account

1. Based on the registration, the buyer can access their customer account.

2. During registration, the buyer is obliged to state all data correctly and truthfully.

3. Access to the customer account is secured by a username and password.

4. The buyer is not entitled to allow third parties to use the customer account.

5. The seller may cancel the user account in justified cases.

V. Payment Conditions and Delivery

1. The price of the goods and related costs can be paid via bank transfer, payment card, cash on delivery, or in cash during personal collection.

2. The buyer acquires ownership rights to the goods by paying the full purchase price.

VI. Withdrawal from Contract

1. A buyer concluding the contract outside business activities (consumer) has the right to withdraw within 14 days of receiving the goods.

2. The buyer must return the goods within 14 days of withdrawal.

3. The seller will return the funds without undue delay, but no later than within 14 days of withdrawal.

VII. Defective Performance Rights

1. The seller is responsible to the buyer that the goods are free from defects upon receipt.

2. The buyer may request a replacement, repair, discount, or withdraw from the contract depending on the defect.

3. The seller decides on the complaint without delay, settling it no later than within 30 days.

VIII. Final Provisions

1. All agreements are governed by the laws of the Czech Republic.

2. The purchase contract is archived electronically and is not accessible.

3. The terms and conditions may be modified or supplemented by the seller.

These terms and conditions take effect on 29.05.2020.

I. Introductory Provisions

For the purposes of these Principles: The Operator, as the Controller of Personal Data, hereby informs about the method and extent of Personal Data processing, including the scope of User rights.

The Operator is a consultant in the field of personal data protection. Personal Data is processed:

• to the extent provided in connection with the order of products/services or contract negotiations;
• for purposes stated below.

Purposes of processing:

• contract performance and service provision;
• fulfilling legal obligations (accounting, tax, archiving);
• marketing and commercial offers;
• protection of the legitimate interests of the controller.

The Operator is the controller. Data is not processed by any other entity.

II. Data Protection and Processing Info

Natural persons sending the order form ("User") are subject to Act No. 101/2000 Coll., on the Protection of Personal Data, as amended.

Data will be processed for the duration of contract negotiations and the duration of the contractual relationship.

Upon contract conclusion, data will be processed for 36 months for potential dispute resolution (legitimate interest).

For legal archiving obligations (Act No. 563/1991 Coll.), data will be kept for 5 years.

Phone and e-mail will be processed for marketing purposes during evidence and 12 months after, unless consent is revoked.

Data will not be transferred to third parties, third countries, or international organizations.

III. User Rights

The User has the right to revoke consent at any time (where processing is based on consent).

The User has the right to:

• request access to their Personal Data;
• request correction or erasure of Personal Data;
• request restriction of processing;
• file a complaint with the Office for Personal Data Protection.

IV. Final Provisions

All legal relationships arising in connection with data processing are governed by the laws of the Czech Republic.

Users providing data do so voluntarily.

The Operator may change these Principles and will inform Users by e-mail at least 30 days before changes take effect.

These Principles take effect on 29.05.2020.
